A Former Prosecutor is Your Best Defense…
Have you been charged with Aggravated Robbery?
In Arizona, a person commits robbery if in the course of taking any property of another from his person or immediate presence and against his will; such person threatens or uses force against any person with intent either to coerce surrender of property or to prevent resistance to such person taking or retaining property. You can commit Aggravated Robbery if in the course of committing robbery (as defined above) such person is aided by one or more accomplices who are actually present.
Aggravated Robbery is a class 3 felony, and can be filed as a non-dangerous or dangerous offense. If the State has indication that there was discharge, use or threatening exhibition of a deadly weapon or dangerous instrument or the intentional or knowing infliction of serious injury on another person, they will consider the charge a dangerous offense.
If charged as a non-dangerous offense, you could be facing a jail term of 2.5 years to 7 years with the possibility of probation for a first offense, 4.5 years to 13 years with one historical prior and 10 years to 20 years with two historical priors.
If charged as a dangerous offense, you could be facing a jail term of 5 years to 15 years first offense, 10 years to 20 years with one historical dangerous prior, and 15 years to 25 years with two historical dangerous priors.
There are several defenses that can be used on this case primarily because the charge is based on the presence of other individuals during the robbery. The biggest defense for this case that The Law Offices of Alex Lane, will argue is “Mere Presence”. So long as the individual does not participate in the offense. It is not a crime to be physically present while the crime is being committed. Other defenses that may be used are Miranda Rights violation, denial of right to counsel, identity issues and more. Alex Lane will look into your case to determine the State’s weaknesses and your strengths.
