Child custody is perhaps the hardest issue to deal with and, unfortunately, in some instances the children’s needs are forgotten about.

When considering child custody, the Court is concerned with what is in the best interest of the child. Our goal is to see that your needs and the needs of your child are lined up appropriately. We want to pursue the child custody or visitation rights that are right for you and your child. The divorce process alone will have its affect on you, but it also has its affects on children. It is important for their growth and future that child custody be awarded to their benefit.

There are two types of child custody: (1) Physical Custody and (2) Legal Custody. Physical custody refers to where the child will reside. Legal Custody refers to the important decisions that need to be made on the child’s behalf, such as health care, education, extracurricular activities, and more.

Additionally, there are two ways in which these types of custody can be provided: (1) Sole Custody or (2) Joint Custody. Sole custody will award full custody to one adult, the child will reside with this adult and all decisions on behalf of the child will be made by this adult. Joint custody allows for a division between parents. Usually the child will reside with one parent, however; he/she will spend an equal amount of time with each parent.
