What Is The Definition of Domestic Violence?

Under Arizona Revised Statute § 13-3601, Domestic Violence is defined as any act which is a dangerous crime against if any of the following apply:
1. The relationship between the victim and the defendant is one of marriage or former marriage or of persons residing or having resided in the same household.
2. The victim and the defendant have a child in common.
3. The victim or the defendant is pregnant by the other party.
4. The victim is related to the defendant or the defendant's spouse by blood or court order as a parent, grandparent, child, grandchild, brother or sister or by marriage as a parent-in-law, grandparent-in-law, stepparent, step-grandparent, stepchild, step-grandchild, brother-in-law or sister-in-law.
5. The victim is a child who resides or has resided in the same household as the defendant and is related by blood to a former spouse of the defendant or to a person who resides or who has resided in the same household as the defendant.
6. The relationship between the victim and the defendant is currently or was previously a romantic or sexual relationship.

What Are the Penalties If I Am Charged With Domestic Violence?

Domestic Violence charges have severe consequences and can be filed as a misdemeanor or a felony. If convicted you could face counseling, probation, jail, prison, loss of gun privileges and can greatly affect your current child custody or future child custody arrangements.

The Court will look at all aspects of the case such as, the extent of any injuries, whether or not a weapon was used, if you have any priors, and more.

If convicted as a misdemeanor you could be facing up to six (6) months jail, and will be required to complete a Domestic Violence Counseling program. In addition, the Court will enter an order prohibiting you from having any contact with the victim or returning to the scene where the alleged offense occurred. In some cases, this may be your place of residency.
