What are the penalties for a DUI conviction?
Arizona has some the toughest DUI laws around. If convicted with a DUI you are facing jail time, extensive fines/fees, alcohol counseling, loss of your driver’s license, ignition interlock device, SR22 insurance, court mandated driving school. The minimum and maximum sentence varies from each type of DUI charge, you can view the sentencing chart pursuant to your DUI charge here.

Will I have to install an Ignition Interlock Device in my car?
Any conviction of a DUI whether it be a standard, extreme or super extreme, carries a mandatory punishment of the ignition interlock device for a minimum of one (1) year.

What if I am an out-of-state visitor?
If you received a citation for a DUI while visiting, every effort can be made to not have to have you travel back to Arizona for court appearances. If you are sentenced to serve any jail time or complete alcohol classes, you may be allowed to do so in your state of residency.

When did the new DUI laws go into effect?
The new DUI laws went into effect on 09/18/2007. If you received a citation prior to this date, the new laws are not retroactive to you.

Can you refuse to take the field sobriety tests?
Yes. You are not required by law to submit to any field sobriety test.

Can you refuse to submit a breath or blood test? If you refuse a breath or blood test the officer will obtain a warrant for such test. By refusing these tests you consequently are facing a license suspension for one (1) year.

What are some of the signs officers look for when searching for a drunk driver?
The following is a list of observations made by officers listed on police reports. These observations, led these officers to believe that the driver was under the influence.

• Driving with headlights off at night
• Drifting into other lanes/bike lane
• Accelerating and decelerating rapidly
• Slow response to traffic signals
• Overly loud music
• Braking erratically
• Wide turns/Illegal turns
• Straddling center of lane marker
• Striking or almost striking object or vehicle
• Drifting
• Following too closely
• Speed below or above posted speed limit

What happens if I was not read my Miranda warning?
If the officer failed to read you your Miranda warning after being arrested, the prosecution cannot use any of your statements or answers to questions asked by the officer after the arrest.

The officer took my driver’s license and provided me with a temporary license. What do I do?
Your driving privileges will be suspended fifteen (15) days from the date of your citation, unless you request a hearing. You are eligible to obtain an identification card through the MVD but are not able to obtain a copy of your driver’s license until after you have served the MVD suspension. Do I have the right to speak with an attorney?
Yes, however; you can only invoke this right upon being arrested or before deciding whether to submit to a blood/breath test. Once the officer has arrested you, immediately ask to speak with an attorney.

What are the symptoms of intoxication?
• Blood shot watery eyes
• Slurred speech
• Odor of alcohol
• Flushed face
• Inability to follow directions
• Failure to comprehend the officer’s questions
• Staggering
• Leaning on something/someone for support
• Combativeness or inappropriate attitude
• Stumbling while walking
