What Is An Administrative MVD Hearing?
After you were cited with a DUI, the officer informed you that you have fifteen (15) days to request a hearing or your driver’s license would automatically be suspended.
An MVD hearing is heard by an Administrative Law Judge, and is held primarily to prove that the officer had reasonable grounds to believe the person was driving while under the influence of intoxicating liquor or drugs. It also is to prove that the person was placed under arrest, the person refused to submit to a breath/blood test, and that the person was informed of the consequences of refusal.
If the Administrative Law Judge orders a suspension, you are able to pick the date that the suspension starts on, so long as it’s a date within forty five (45) days from the date of your hearing.
Based on the findings the Administrative Law Judge may suspend your driver’s license for a period of ninety days to one year. You may be entitled to a restricted license permitting you to drive to and from work, etc.
